1. Introduction & Acceptance
Welcome to HireAegis Interviewer ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our technical interview platform and related services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
You must be of legal age in your jurisdiction to use the Service, or have the consent of a parent or guardian if you are a minor. The Service is not intended for users under the age of 13.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you may discontinue use of the Service.
2. Service Description
HireAegis Interviewer is a technical interview platform that enables interviewers to conduct coding interviews with candidates. The Service includes:
- Interview Rooms: Create and manage scheduled interview sessions with candidate access links
- Code Editor: Browser-based code editor with autosave and real-time synchronization
- AI Assistant: AI-powered assistance for candidates during interviews (all conversations visible to interviewers)
- Build System: Docker-based code execution and preview for Next.js projects
- Real-time Collaboration: WebSocket-based real-time viewing of candidate work by interviewers
- Workspaces: Organization and team management features
We provide the Service "as is" and do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any aspect of the Service at any time.
3. User Accounts & Workspaces
Account Creation
You may create an account through our authentication provider (Clerk). You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Workspaces
The Service allows you to create and manage workspaces for organizing interview rooms and team members. You are responsible for managing workspace members and their access levels.
Account Responsibilities
You agree to:
- Provide accurate and complete information when creating your account
- Keep your account information up to date
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized use of your account
- Use the Service in compliance with all applicable laws and regulations
Account Termination
You may terminate your account at any time. We may suspend or terminate your account if you violate these Terms or engage in any activity that we determine, in our discretion, is harmful to the Service or other users.
4. Subscription & Payment Terms
Subscription Plans
We offer the following subscription plans:
- Starter: $69/month or $662/year (20% annual discount) - 20 interview sessions per month, 5 workspaces, 10 team members
- Professional: $149/month or $1430/year (20% annual discount) - 50 interview sessions per month, 10 workspaces, 20 team members
- Business: $299/month or $2870/year (20% annual discount) - 100 interview sessions per month, 25 workspaces, 50 team members
We may also offer custom plans under separate agreements.
Subscription plans, features, and pricing may change from time to time. We will provide notice of material changes to pricing.
Billing Periods
Subscriptions are available on a monthly or yearly basis. Billing periods begin on the date of subscription activation and renew automatically unless cancelled.
Payment Processing
Payments are processed through Lemon Squeezy, a third-party payment processor. By subscribing, you agree to Lemon Squeezy's terms and conditions. We do not store your full payment card information.
EU Consumer Rights
If you are a consumer located in the European Union, you have the right to withdraw from your subscription within 14 days of purchase, in accordance with the EU Consumer Rights Directive. However, if you have given explicit consent and acknowledged that you will lose the right of withdrawal once the digital content is made available, this right may not apply to digital services that have been fully performed.
Refunds (Unused Credits)
We offer refunds for unused session credits for new subscriptions within 60 days of sign up. Used credits (sessions already consumed) are not refundable. This is in addition to any EU consumer withdrawal rights you may have.
Session credits are allocated per billing period and may expire at the end of the applicable period (monthly or yearly), unless otherwise stated.
Cancellation
You may cancel your subscription at any time through your account settings or by contacting us. Cancellation will take effect at the end of your current billing period. You will continue to have access to the Service until the end of your paid period.
Refund Requests
To request a refund for unused session credits within 60 days of sign up, contact support. We may ask for subscription and workspace details to locate the relevant credits.
Price Changes
We reserve the right to change subscription prices at any time. We will provide advance notice of price changes as required by applicable law. For existing subscribers, price changes will apply to subsequent billing periods, unless otherwise specified.
5. Acceptable Use Policy
You agree not to:
- Use the Service for any illegal purpose or in violation of any applicable laws
- Transmit any content that is harmful, abusive, harassing, defamatory, or otherwise objectionable
- Attempt to gain unauthorized access to the Service or any related systems
- Interfere with or disrupt the Service or servers connected to the Service
- Use automated systems (bots, scrapers) to access the Service without permission
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service to transmit viruses, malware, or other harmful code
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Use the AI assistant to generate harmful, illegal, or inappropriate content
- Abuse system resources or attempt to circumvent Service limitations
We reserve the right to suspend or terminate accounts that violate this Acceptable Use Policy.
6. Intellectual Property
Platform Ownership
The Service, including all software, designs, text, graphics, and other content, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.
Candidate Code
Code written by candidates during interviews may be used by interviewers for evaluation purposes. We do not claim ownership of candidate code, but candidates should be aware that their code is visible to interviewers and may be stored as part of the interview record.
User-Generated Content
By using the Service, you grant us a license to use, store, and process any content you submit through the Service as necessary to provide the Service and as described in our Privacy Policy.
Trademarks
"HireAegis" and "HireAegis Interviewer" are trademarks of ours. You may not use our trademarks without our prior written permission.
7. AI Assistant Terms
AI Provider Disclosures
The AI assistant feature uses third-party AI providers (including DeepSeek and OpenAI via RubyLLM) to generate responses. By using the AI assistant, you acknowledge that:
- Your prompts and conversation context may be sent to these AI providers
- AI providers may process data in jurisdictions outside the European Union
- We use appropriate safeguards, including Standard Contractual Clauses, for international data transfers as required by applicable law
AI Response Accuracy
AI responses are generated by third-party providers and are not guaranteed to be accurate, complete, or appropriate. You should not rely solely on AI responses for important decisions.
Interviewer Visibility
All AI conversations between candidates and the AI assistant are visible to interviewers in real time. This is by design to provide interviewers with insight into how candidates use AI tools during interviews.
Candidate Awareness
Candidates are informed that their AI conversations are visible to interviewers. By using the AI assistant, candidates consent to this visibility.
8. Docker & Code Execution
Temporary Container Execution
The Service uses Docker containers to execute and preview code written during interviews. These containers are temporary and are cleaned up after approximately 6 hours.
Security Limitations
While we implement security measures, code execution in Docker containers has inherent security limitations. You should not execute untrusted code or code that could compromise system security.
Resource Constraints
Docker containers are subject to resource constraints, including CPU, memory, and network limitations. We reserve the right to limit resource usage to ensure Service stability.
Container Cleanup
Containers are automatically cleaned up after a grace period (typically 6 hours). We are not responsible for data loss after container cleanup.
9. Data & Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. Please review our Privacy Policy to understand our data practices.
We collect and process data necessary to provide the Service, including:
- Account and workspace information
- Interview room data and participant information
- Code and project files created during interviews
- AI conversation data
- Subscription and billing information
Candidate data (display names and optional email addresses) is collected for interview purposes and is visible to interviewers.
10. Limitations of Liability
Service Provided "As Is"
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
No Warranty of Accuracy
We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not guarantee the accuracy, completeness, or usefulness of any information provided through the Service.
Limitation of Damages
TO THE EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.
Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any rights of another party.
11. Termination
Termination by You
You may terminate your account at any time by cancelling your subscription and contacting us to request account deletion.
Termination by Us
We may suspend or terminate your account immediately, without prior notice, if you violate these Terms or engage in any activity that we determine, in our discretion, is harmful to the Service or other users.
Data Deletion
Upon termination of your account, we may delete or anonymize your data in accordance with our Privacy Policy and applicable law. Some data may be retained as required by law or for legitimate business purposes.
12. Dispute Resolution
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to conflict of law principles. However, if you are a consumer located in the European Union, certain mandatory consumer protection laws of your country may apply.
Jurisdiction
Any disputes arising out of or relating to these Terms or the Service shall be subject to the jurisdiction of the courts of New Jersey, United States, except where mandatory consumer protection laws require otherwise (such as for EU consumers, who may have rights under EU law).
EU Online Dispute Resolution
If you are a consumer located in the European Union, you may use the European Commission's Online Dispute Resolution platform (https://ec.europa.eu/consumers/odr/) to resolve disputes.
Dispute Resolution Process
We encourage you to contact us first to resolve any disputes. If we cannot resolve a dispute through direct communication, disputes will be resolved through the appropriate legal channels as determined by applicable law.
13. Miscellaneous
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Changes to Terms
